Small update: Audi seeking if they can get a better quote from BMW Constantia to repair the car to motorplan compliance.
Bank is observing the process.

If this is the same car from the other threads on other sites; what about the functionality they lied about being in the car via the ConnectedStore? Or this a smaller problem

Good afternoon.

I hope this message finds you well.

Following a recent discussion with BMW South Africa, we’ve received confirmation regarding several critical compliance concerns with our vehicle's motor plan. Based on the vehicle's VIN, BMW has specified that the car is originally equipped to use only RUN FLAT, star-rated tires. The use of non-star-rated or non-run-flat tires not only places the car at risk of voiding the motor plan but may also lead to safety and performance issues. Additionally, there is concern over x3 rims that show signs of prior repair; BMW has pointed out that any unapproved third-party repairs like Mag Master could further affect components such as the shocks, control arms, and related systems.

Reviewing the motor plan terms on BMW’s website, section 8 of the contract states (Clause 8.1.1) that any unauthorized modifications, repairs, or maintenance without written consent from BMW will void coverage, as specified under Clauses 3.2.1 and 3.2.2. I’ve also attached a copy of the motor plan checklist, which reiterates in item 4a that BMW disclaims liability for any damage arising from the use of non-approved or non-star-rated tires, effectively forfeiting coverage for suspension and drivetrain components.

Additionally, BMW South Africa raised concerns regarding aftermarket headlight bulbs, which could impact motor plan validity for any issues related to the headlights or associated systems. They have informed us that they will be investigating further with BMW Bloemfontein.

As these issues were not disclosed before purchase in Cape Town and given that we bought this car with the intention of extending the motor plan, the potential voiding of coverage for these critical areas is deeply concerning. Investing R390,000 only to face the risk of a voided plan is unreasonable, especially given BMW’s apparent difficulty in addressing or resolving these issues directly.

In light of this, we are formally requesting that either Audi Bloemfontein or BMW Bloemfontein cover the costs to restore the vehicle to meet BMW's motor plan standards. These restorations must be completed through BMW’s authorized service network to ensure compliance.

The BMW must be properly inspected and written in paper of compliance to ensure the integrity of the MP and for it’s later extensions.

If these compliance issues are not addressed, then the vehicle was effectively sold with unadvertised defects, and we will seek to return the car under CPA & contact MIOSA.

Please find all supporting documentation attached for reference.

I applaud you for the warm intentions still, lets see what happens...I feel for you through this situation but "one bitten, twice shy" and I will just let them have it back and get something else.

Good. Hope this is at least a best of bad options outcome and the car serves your folks well. Kak experience overall but you stuck it out.

Having owned a few BMWs out of plan, I’d say it can get pricey, real quick…..

I would propose your folk get into a cheaper car to run for the long term. This vehicle motor plan will run out in 12 months (Oct 25), post that, its a hope and pray strategy: hopefully nothing goes wrong, or a lot can go wrong.

I saw your emails are more geared towards “fixing / restoring to BMW standards”….perhaps also see if you can still get out of the deal. Might save you lots of money in the long term.

Do you guys think the car needs a compression/leakage test? BMW Bloemfontein according to service history replaced the spark plugs.

BMW Constantia informed me that Audi Bloemfontein is taking the tyres and rims? Did we pay for these in the initial purchase?

Your parents are getting new rims and tires. Let the buckled ones go as your folks should have done with the entire car.

Just apply some common sense Mr Krabs - if they are screwing you over somehow by all means get upset, but they are going to try to now 'rectify' everything that has been identified so far. Bear in mind you have agreed to let them do this. Now you lie in the bed you have made as they WILL do this as economically as possible for themselves. Frankly I am amazed that they agreed to rectify this with that size of bill - shows you they acquired this thing for MUCH less than it was sold for. Anyway rectifying things may involve recovering all the parts they are replacing and selling them - who knows? Either way you have to now wait for them to finish this rectification and observation and whatever else is going on.

What happens in future is anyone's guess right now - but as everyone has mentioned you had to choose between paying some school fees now or having the chance of paying school fees later if something else comes to light later on.

I understand, thank you. We were going to lose 10% as a cancellation fee. We will wait and see how it goes.

Ok- maybe I haven’t acted on all the advice as quickly as I should have. But it’s a learning process for me, and I’m trying to weigh different perspectives as I go. Appreciate everyone’s patience and the insights here.

I also just wanted to ask as Audi didn't say anything in regards to that to us. BMW Constantia phoned me saying that Audi is taking the old rims and tyres back. I don't think they will take back the BMW issued mobility kit too.
