Im so sorry for your loss, If insurance write it off then buy it back and fix. This would be an ideal time to do a facelift conversion if you so wish, facelift sedan parts easier to find than pre-facelift body parts.

So this is the first time I am involved in accident.
Do the insurance take the vehicle, even if it was bought cash? Or why do I have to buy it back? I assume that means they become the owner after paying out money when writing it off?

Yes - buying it back refers to the situation where insurance write the car off and pay you out. The car is then the property of the insurers, and you can buy it back if you want to repair it.

Buying it back has BIG cons attached to it. Yes you could probably get it fixed for very cheap as most of the parts will be easily sourced from scrap yards but the BIG problem is what the papers will say!

your car will be registered as a code 3 write off and will be worth F-All!

Personally I would never buy a written off car back unless I was going to do something funky with it like a big turbo conversion or build it into a track car.
Even if you get into another accident and they see that its a code 3 you might find yourself a bit of a pickle!.

Do some research into this subject and try not be too sentimental about all of it which I know is hard as we all get attached to our cars.

na..i had the option of buying my 330i back & was not going to be code 3

i agree he should check but as far as i know this is the standard..if you buy the vehicle back...its not coded..same thing with my Honda...its why you have accident damaged and repaired cars for sale with normal coding.

The damage looks superficial, if the insurance want to write it off then I would rather not go the insurance route and rather fix it out of pocket. This car is too clean to scrap, please don't send it down that route. Help your insurance in any way to fix instead of scrap and stick it to the honda insurance!

Use it as an opportunity to facelift the front to whatever your desire.

Too much bang for buck with a clean E46 like this. Writing cars off based on inflated quotations and book value erks me.

If it were me I'd definitely buy it back. I mean, what are you gonna buy with the payout that could equate to this car?

There's no way that will be made a Code 3.

Simple explanation here:

Insurance write-off simply means the car is "beyond ecomonical repairs". Each insurer has their own % threshold of repair cost vs insured value. If the cost to repair is more than that % then they write the car off.

Code 3: A car is only made a code 3 when it has suffered severe structural damage but can be repaired.

So ja, if the car hold enough sentimental value to you its not a bad thing to buy it back. The value will not be affected if it's properly repaired.

Your other option, if your insurance company allows it, is for them to pay you out an agreed amount to repair the car yourself. That way they wont wrote it off and take ownership of the car and ownership will remain with you. I'm not sure if they still do this but a few insurance companies used to offer this if you ask nicely.
