Since government decided to get their finger in the pie and score money from fines, they started with this AARTO crap all those years ago, under the RTMC (Road Traffic Management Corporation) it never worked!!

Fines became a money making scheme being endorsed by a private company, where even when you write a letter of appeal you still get charged R250 extra if the appeal fails, which is crap cause you have the right to appeal for free by law.

...so in short the entire system as it stands was turned into a business set on making money, and abusing the law and the authority of Metro cops to do so...

The roadblocks are a good thing, allowing cops to catch allot of criminals, find stolen cars, drugs, guns, and unfortunately roadworthy cars, but now again this is being turned into a tool for collection of money, and nothing else.

Pathetic how the enforcement of law is being sidelined in the name of funds, and how the law is now just another business.

Yes I understand that this is for collecting fines for infringements committed and laws broken, and that town councils need money to run, and Metro Councils even more so, but before AARTO everything worked fine, with councils collection processes in order...AARTO should never have happened and be managed the way it was!!!

Being a Spietkop for 22 years now, I really hope and pray for the day that our excuse for a government start realising the harm they are doing to country, and how them abusing the authority is breaking down our beliefs is the law, and in them

I read an interesting article which states they are only allowed to arrest you if they have a warrant of arrest or if they have the original summons. I have also read they are not allowed to drive your car and you can lay a charge of theft against the state if they do. I was stopped some time back and the metro cops started searching my car with the excuse that I might state that they stole something. The one officer wanted to drive my car back to the police station when I asked to see his badge and wanted to know his full name.

The article by the AA states you are entitled to see their badge and get their full particulars but they always think you a smart Alec when you ask.

That's the problem, you can't question what they are doing or you will get into a world of trouble.

In my opinion, and by what I understand from the law - NO WAY IN HELL!!!!

Only when you have a summons, as in warrant of arrest, then you can be arrested on scene, or the summons printed on scene, and that you HAVE to pay or sort out immediately.

Concerning the fines outstanding, they can bring them under your attention, and offer you a way to pay, but they are not allowed to detain you for that - only warrants.

PS: Just remember to always stay calm, and friendly, cause as soon as you get cocky or arrogant, then they will probably do everything in their power to screw you around, or even arrest you for Failing to follow the instruction of a police officer, or anything they can think of...

This is true.

By law every officer HAS to wear a name tag, or in most cases it is now pre-printed on the shield, including the Force or Pay number.

See my Tshwane Metro Police shield as example.

Now if a cop don't have this on, then you have grounds to te tell him he has no right to talk to you, and demand someone in Full uniform to assist you.

Again I say, stay calm, and friendly, and cooperate as much as possible, but remember, you also have rights

I regret to say that I have a somewhat bigoted view of "spoetkops" (apologies Cois as you come across as a gentleman).....in times gone by, the "Highway Men" wore a mask to disguise their identities when they held the stagecoach to ransom and robbed the travelers....these cnuts these days don't bother.

I have always and will always hold the view that SPEED DOES NOT KILL.....in-appropriate speed for the prevailing road conditions cause accidents which result in death.

Those accidents more often than not would be the result of MOVING VIOLATIONS....changing lanes unexpectedly without signalling, hauling down the left lane passing a que of traffic and forcing your way into the right lane etc etc etc.

Then, the ever growing "Curse of the Smart Phone" ....the whatsapp while you drive, text while you drive and surf the web while you drive types. This is in my humble opinion rather like Russian Roulette. And again, these things go unnoticed by the SpietKop sitting in a deck chair behind a bush firing away with his/her laser cam cash register.

So, whats the solution? Ban all speeding equipment for 12 months. Take every Spietkop and pay them PER KILOMETRE patrolled in their cars. Fit every car with a live feed high quality camera to film MOVING VIOLATIONS.

Then, when Spietkop pulls the offender over, he/she WILL conduct the process in full view of the patrol car camera. Go off camera and you are deemed to have taken a bribe and you will be FIRED.

I am willing to bet a great deal of money that if we all knew that there were rolling camera platforms driving in traffic with us (say 50% unmarked cars) we would very quickly think twice about behaving like pratts on the road.

Let me paint a quick scenario;

Wideopn-Zn leaves home to drive to the office. Its a 70km commute on the busy N3 highway from Hilton to Hillcrest. WO-ZN thinks he's awfully clever so he ducks down the left lane and flys past the traffic like a hero. One of the cars he passes is an unmarked camera platform who radios out to his mates.

WO-ZN thinks he wasn't noticed but at Cato Ridge a marked patrol car catches up to him and signals him to pull off. He is ordered out of his car to stand in front of the bonnet of the patrol car. Plod has by now received full driver particulars from the control room so begins the conversation.

"Good morning Mr Oram from ** W*****n Rd Hilton. How are you today sir?"

"Why did you pull me off:RedNo: haven't you got better things to do like go after taxis and trucks"

"Well sir well get to them as well but for the moment we are concerned only with your behaviour. There is a video clip filmed of you passing on the left and cutting infront of a vehicle at Ashburton. You are welcome to request a copy of the video to be sent to you. By doing what you did, perhaps you werent aware but the car you cut in front of had to brake hard and this cause a chain reaction back along the line of traffic. It was dangerous sir.

"Well the should have been in the left lane"

"Sir the road is busy, that is the nature of rush hour. Now, I am issuing you with a warning (citation perhaps?) and ask that you just take it easy on the road sir. Have a great day"

Plod gets back in his car and immediately on his I-pad / Tablet captures the data of the above incident.

10km's later WO-ZN hasn't learnt his lesson. So the first thing that happens is when another officer types in the reg number is that the mornings citation is flagged up. When WO-ZN is pulled over, he is then issued with a fine which DOESN'T involve cash but points off his licence.

That said, when I was working out on the road, I focussed on moving violations, like you mentioned, driving erratic, unsafe lane changes, red lights being skipped, stuff like that.

Speed does not kill...it's the sudden stop. :rollsmile:

ja i think the focus is totally wrong as you said...the government is focusing on speed & they have for a while now...even reducing max speeds which is crazy...we all know that its at intersections etc. thats the main problem. when you lose 10 lives in a taxi crash. i Don't understand why they don't have a separate set of penalties for buses & taxis as it public transport. You skip a red robot twice & you can never drive a taxi again.

You have to reduce the speed limit to 27.5km/h before a partial head on collision is almost guaranteed to be survivable. Remember cars are tested by being driven into a block at 55km/h.

Most dual carriageway roads you have a closing speed of 240km/h

Well, two vehicles colliding as a head on accident (presumed to be doing 120kph) has a combined speed of 240kph.
