Beware what you post on Facebook, Twitter, and Instagram because it may be used in evidence against you.

Maria Philippides, director at Norton Rose Fulbright, chats to Bongani Bingwa about how insurers may use photographs you post to counter claims you submit.

But, very often, that is the kind of information that a prospective employer or an insurance company would want to look at because it affects their business in some way, she says.

Legally they are entitled to do so, she says.

It is then considered a publication.

When there are privacy settings in place, she says there are even cases overseas where courts have compelled people to make their social media passwords available so that profiles may be scrutinised because it has relevance to a particular case.

There was such a case where the claimant was found to be wearing the alleged stolen ring in a Facebook post.

Another example would be if a driver was accused of being on their cellphone at the time of an accident, then the insurer can ask for copies of cellphone accounts.

Insurance companies can subpoena any information that may be relevant to a case.

While this is not "news" to most of us, as we've had discussions on this forum in the past relating to possible insurers lurking on the forums or BMW spies looking for information to warrant voiding someone's motorplan, it's clear that access to any information by authorities is a reality and so I just want to point out to everyone that you'd be most fortunate ensuring the information you post here or on any other forum or form of social media doesn't get you into the type of situation where it would be used against you.

What i post here is for advice and guidance and i also feel like part of a huge family that shares my passion for cars

I can attest to what chef is saying, i posted how shit dotsure was and they phoned me cause they saw my post on this forum, needless to say they are crapsure and are still really shit

Very interesting. I was sure facebook is monitored, but that a company monitored this forums is interested. But could be someone that works there that is a member on here.

Insurance will go to the ends of the world to not pay a claim and yet when they want you on board they will call you even when you are in the shower just to get your business.

Sad...

It's the ultimate business to be in. Have millions of people pay you thousands each month and never have to pay anything out.

As I've posted before, I have first hand experience with my Subaru. Not just your own social media profile to worry about - if you are at an event MANY people are going to be recording or taking pics of your car and believe me when I say they will NOT remove them or their comments off social media regardless of how misleading they are. Revolt Racing had MiWay hack into it (like register a profile and circumvent security resulting in them self-approving the profile) to get information to deny a HAIL claim for a member on the basis of him having participated in a gymkhana. They are out across social media in full force. There are also new 'veracity testing' solutions that have been put into place on high value claims that go far beyond voice stress analysis.

Since that rather interesting experience LITERALLY EVERYTHING I speak about or on my profiles is listed with my insurance company (from exhaust and carbon parts even down to pedals and steering change together with invoices for everything) since they CAN and WILL use this to deny a claim if it is not explicitly listed (the price didn't go up appreciably in my case)... Also why I am so against the Discovery model of continuously monitoring you under false pretences.

Same goes for motorplan... rather err on the side of caution in what you talk about. You can ask mods to take down threads and we comply but there are other blogs, social profiles of others and forums out there that might not or might even want to cause issues for you. Again I've experienced this first hand at an un-timed event where a poster refused to retract a time related comment.

I have had 3 x accidents in the past 2 years and my premiums have remained largely unaffected. Only the usual industry norm increases. (of more below)

The accidents were not my wife's or my fault. We were driven into. The 2 x big accidents were both unlicenced drivers (the second one so piss drunk he could barely stand) so prospects of recovery were zero.

So if you feel you are just having money taken off your account and when a claim happens then you have to fight well then you are with the wrong insurer. Don't blame the "insurance business" in general.

Like ANY business, they exist to make a profit. They're not a NGO or non-profit entity.

As far as I am concerned, if people behave like pillocks, post their behavior all over social media and then come unglued resulting in a claim well then that's tough. Shame.

People who behave this way are the reason we ALL land up with premiums going up generally. This is what I alluded to in my second paragraph above. When idiots stuff up and claim (like get drunk and total a car) we all get affected ultimately.

insurance companies are basically assholes...had pieces of sh!t from Dial Direct calling people who live in my street on their cell phones asking questions without declaring who they are..any reason not to pay...nice ads & low premiums but screw you when you claim..my experience with Outsurance was decent with my household but also depends on who takes your call..you can get an asshole and you have a different result & you have to fight...im with Santam & i must say i have had no bad experiences...i can be straight and honest with them & they payout. I went with them after my cousin had an accident ..he was driving in a dangerous area & overtook a car at a stop sign...the car then turned right & he went into a pole..the car drove straight & left the scene...he told them this and they paid his claim & i was sold!

Family member of mine had the same experience with the insurance calling neighbours. If I'm not mistaken it was the same company :thumbdo:

Yes they are not an NGO but there is no denying that insurance will do all within its power to not payout.

1. Car gets stolen in full view of cameras at a restaurant in Krugersdorp. There is video footage of the criminals breaking into the car and taking it. Took 4 months to pay out and not even the full amount after they had called everyone involved including the restaurant owner and all the waiters and even interviewed the security guards outside while threatening to have them deported because they were illegals.

2. Neighbors car catches fire spontaneously while parked in the middle of the night in our estate with cameras as well. There is no evidence of tampering or mods on the vehicle and his insurance takes over 5 months to pay out after investigating his service history, his driving history for his tracking company and interviewing us as if we saw anything.

3. Buddy has a dash cam mounted in his car. Gets rear ended at an intersection and insurances response after the investigation is he was over the pedestrian line. If he was behind it then when he got hit from behind he would not have hit the passing cars.

4. Uncle leaves the country for a bit on business and his disc expires while he is away. Part of the parking structure falls due to wind and smashes the windshield and dents the roof. He gets someone to do the claim on his behalf to his insurance who are still debting his account every month and they decline the claim because the disc was expired 3 months earlier. :dunnoanymore:

I am sure there are more examples out there of when people have been fvcked by insurance.
