BMW South Africa ordered to repay customers for “on-the-road” fee

and I dont believe they should be paying it back it was your choice to add it to the finance stop blaming everyone else for your mistakes.

Who says these guys added it to their finance and it wasn't deducted from their deposit, thus making the deposit on the actual price of the car smaller.

In the end, they are financing a higher amount than they should have been.

No need to tell the guys here that "it's their fault".

sorry dont get me wrong not trying to point fingers - but I do believe that when you are signing all those papers that its is actually mentioned twice (please correct me if im wrong) - where you have to sign that the on the road costs are apart from the price as per the "LAW" and in doing so you take the onus on yourself when you decide to put it on as part of the finance (hence your fault)

:thumbs: good luck to the guys who have to resolve this, but to any future buyers take heed when buying a car n finance the hidden cost you are always warned about, and read the fine print please.

I get them to remove the "on the road charges" and offer to go and register the car myself. You should see how they back peddle when you do this. Don't pay the charges, full stop. It's just a money making scheme.

IMHO

I hate that an On-the Road fee differs and is not broken down.
I totally agree with TurboLlew that the intricacies of this ruling do not allow for Refunds.

I believe in future the term 'on the Road Fee' will be done away with and replaced with specifics or some other General term.
This will then be a value that is not financeable. Will thus decrease the Deposit or the Discount.

I got directed to some other people from BMW to contact. But I'm also interested in what's going to happen. By the sounds of it then, you could get a refund, but owe the money then in cash instead of as part of your credit...? I'm not so sure. I think I will wait and see what happens with this before I go any further.

@TurboLlew hit the nail on the head. I wonder if BMW will attempt to make contact to those that are owed refunds (be in the full amount or only the interest portion) in any way. The fact that BMW has been placed under audit for this will be interesting to follow.

I wonder if this applies to each and every vehicle finance contract that has been signed up or a specific period?

I financed with them in the early 2000s.

Also how is this tested? The dealer puts the on the road fee amount on their invoice, so your financed amount is
vehicle + extras (including on the road fee) less trade-in difference less deposit. Was BMW Fin adding another
On the Road fee as part of the finance contract fees, in addition to an initiation fee.

If one Bank has been taken to task by the NCR, does this ruling not affect the car financing industry as a whole?

I pulled out an OTP that was sent to me by BMW when I purchased my 2012 F10 520d in November 2014, on the OTP it clearly states "on the road costs" R3,500 - have set this off to the sales executive that did the deal along with this notice now :fencelook:

The National Credit Regulator incorrectly accused BMW Financial Services of charging costs not permitted on credit agreements. The on the road fee is a cost charged by every dealer/manufacturer and financed by all Financial Institutions not just by BMW Financial Services. You will remember that the amount appeared on the offer to purchase as well as the invoice and it was disclosed to you.

They are in the process of appealing and a press release will follow shortly.

Thank you for your email. I am aware of the article recently published by times live, however at this point BMW Financial Services has to still supply an audit report to the NCR. This enquiry is still in initial investigation stages for both parties and no decisions on refunds can be made right now.

I have no doubt that in due course the investigations will be concluded by the NCR and ruling decisions will be implemented.

I knew this "on the road cost" was total bs when I noticed it was a different number at different dealerships and some salesmen say they will reduce that amount to make the sale. I know from personal experience that on the road charges are R350 for a roadworthy certificate and R258 at licence department to have the car transferred into your name. Depending on how many months left on current disc you will pay the outstanding so you have a paid yearly licence. Annual licence fees on a bmw around R600 so "on the road" fees will never exceed R1200. BTW I do all my own vehicle licencing and roadworthy and pretty regularly too since I have been buying up all the clean 325i tourings I can find.

Oh please, I have never gotten a full tank of fuel on any of my purchases. In fact I get the latter, once picked up a m3 for a client with 0km range left, was bucking from fuel starvation as soon as l left the building...

Hi guys, for me it's simple, I negotiate a "driving home" price, that's the price I am willing to drive that car home at.. Most times I have found they waiver the on the road fees... I change my cars once a year. So yes always read the fine print and know what you are being invoiced for before you sign anything. I have walked away from deals that I did not agree with. Also I doubt anybody will be getting refunds.. Unless they totally forfeit the "On the road fees"....

I always got a full tank when buying a new car, what is More shocking in that I found the Slip in the center console for what the Full tank cost them.. Was shocked, I would also like to pay that for fuel! :skit:
